These are our Terms
Figure.NZ is a collaborative website that presents data on a wide range of subjects relevant to New Zealanders. It is provided by the Figure.NZ Trust (we, us), at figure.nz (Figure.NZ). We hope that Figure.NZ is a valuable source of information that helps you to draw your own conclusions, develop your own opinions and make your own decisions.
Figure.NZ might not always be perfect
Figure.NZ is provided on an "as is" and "as available" basis, and you use it at your sole risk.
We have taken every effort to ensure that the data supplied on Figure.NZ is correct. However, the data has been supplied by a number of different contributors and compiled from a range of different sources, meaning that neither we nor our contributors can give any guarantee that it is (or will remain) accurate. You agree that neither we nor any of our contributors, data sources, affiliates or sponsors will be held liable for any misleading or incorrect information provided on Figure.NZ.
We disclaim and exclude all implied conditions and warranties to the maximum extent permitted by law. To avoid doubt, we do not warrant that Figure.NZ (a) will meet your specific requirements, expectations or be fit for your particular purpose; (b) will be uninterrupted, timely, secure, or error-free; or (c) that errors will be corrected.
Patrons disclosed on our website or through social media do not endorse or assume responsibility for any of the material available on Figure.NZ.
The information on Figure.NZ is provided for informational purposes only and is subject to change without notice.
These are your responsibilities
You are responsible for all activity resulting from your use of Figure.NZ. You indemnify, and will keep indemnified, us against all forms of liability, actions, proceedings, demands, costs, charges and expenses which we may incur or be subject to or suffer as a result of your use of, or inability to use, Figure.NZ.
You must not use, or assist anyone to use, Figure.NZ (a) for any illegal or unauthorised purpose; (b) for any malicious means, or to abuse, harass, threaten, intimidate or impersonate any other person; (c) to upload or transmit any virus or malicious code; or (d) for any purpose other than providing data about New Zealand in an accessible format.
Figure.NZ links to third parties that we do not own or control
Figure.NZ provides links to other applications and websites to facilitate the easy sharing of information. Even though these applications and websites are accessible through Figure.NZ, they are not owned or controlled by us. We are not responsible or liable for, and you release us from, any loss or damage incurred by you as a result of your access to those applications and websites.
Most material on Figure.NZ is licensed under a Creative Commons License
You agree that material on Figure.NZ is, unless otherwise specified, licensed under a Creative Commons CC BY Attribution 3.0 New Zealand License. This means you are free to copy, distribute and adapt the material, as long as you attribute the original data sources and Figure.NZ, and abide by these Terms.
Sometimes material will not be free to use for commercial or other specified purposes. While we try our best to identify restricted material by indicating the relevant license, you are responsible for checking whether reproduction is permitted for your intended purposes. In all cases original sources must be cited. The definition of the different Create Commons licenses we use can be found here.
The material on Figure.NZ is reviewed to help ensure that it is accurate and not misleading. By entering into these terms, you agree not to manipulate the material available on Figure.NZ in a manner that misrepresents the data.
Contributing to Figure.NZ
As a collaborative website, we welcome any contributions to Figure.NZ. You can register and create graphs here which we will audit and publish. We reserve the right to decline to add your contribution to Figure.NZ at our sole discretion.
You can also contribute to Figure.NZ in other ways, for example, by providing data or permission to use data, by providing guidance in your area of expertise, by notifying us of any content errors or technical bugs, or by making topic suggestions. We do not claim ownership of any intellectual property rights in relation to the information or content you submit to Figure.NZ, however you agree to grant us a royalty-free license to use it for the purposes of operating Figure.NZ. You confirm that any content you submit to Figure.NZ does not contain any thing which breaches any obligations of confidentiality or proprietary rights of any third party.
Seen offensive material or a copyright infringement on Figure.NZ?
We will investigate notices of copyright infringement. If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on or through Figure.NZ, please notify us via email at email@example.com.
We reserve the right to remove any content that we consider (in our absolute discretion) to breach these Terms.
We can amend these Terms and Figure.NZ
We may amend these Terms from time to time without notice. When posted on Figure.NZ, the amendments will be effective immediately.
We may make changes to Figure.NZ which may add, modify, and/or remove features without notice.
If you continue to use Figure.NZ after any changes, you’ll be taken to have agreed to the changes.
This is a legal agreement
These Terms are governed by New Zealand law, and all users submit to the exclusive jurisdiction of the New Zealand courts for any matter or dispute arising in relation to these Terms.
These Terms represent the entire agreement between you and us in relation to your use of Figure.NZ.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full effect.
If we do not exercise or enforce any right available to us under these Terms, it does not constitute a waiver of those rights.
